Man gets jail, probation for bomb scare at City Hall

Waukesha - The man who pretended to bring a bomb into Pewaukee City Hall in July in an effort to overthrown the government was sentenced today to four years probation and two months in jail.

Malcolm W. Richards, II, 27, formerly of the Village of Pewaukee, entered not guilty pleas to felony charges of extortion by threat of injury and bomb scare. The extortion charge was reduced in a plea agreement from a more serious charge of armed robbery.

Richards, an Iraq war veteran who suffers from schizophrenia, is a much different person than the one who held up in a City Hall restroom July 28 wearing a device that made it appear he had a bomb, said his attorney Anthony Rosario.

"This incident is the result of a serious mental illness," said Rosario.

Waukesha County Circuit Court Judge Lee S. Dreyfus ordered Richards to six months in jail, but stayed the last four months. If Richards violates his probation, he could be ordered back to jail for part or all of the remaining four months of his sentence. Richards, who had been in jail for 77 days, will serve his sentence in the work-release jail.

Richards went to City Hall at 4:15 a.m. and hid in a restroom. He left a note on the floor which was found by a city police officer at about 9:20 a.m. The note said he had a bomb strapped to him and demanded a weapon, the keys to a squad car and be taken to the vehicle, according to the criminal complaint. 

Richards said in the note he intended to "shoot congressmen and senators," according to the criminal complaint.

Ex-HHS coach gets prison for having sex with student

Waukesha - Matthew Pagel, an ex-coach at Hamilton High School, was sentenced this afternoon to six years in prison for having a sexual relationship with a girl for nearly a year.

Pagel, 24, of Menomonee Falls ,had sexual relations with a HHS student from September 2006 to the summer of 2007. Waukesha County Circuit Court Judge Lee S. Dreyfus also sentenced Pagel to four years of extended supervision followed by three years of probation.

"I can't describe your behavior as anything but reprehensible," Dreyfus told a weeping Pagel.

Dreyfus said Pagel was put into a position of trust as a coach and paraprofessional at HHS which he violated.

Pagel had sexual relations with the girl when she was 15 years old and by the time of the last assault the girl was 16-years-old.

Pagel was charged with two felony counts of sexual assault of a child under 16, three felony counts of sexual assault of a student by school staff and three misdemeanor counts of sexual intercourse with a child who is 16. In a plea agreement with prosecutors, he entered a guilty plea to the three counts of sexual assault of a student by school

Pagel was paid by HHS to be the freshman girls volleyball coach, the head freshman boys basketball coach and the junior varsity girls softball coach during the 2006-07 school year.

Ex-alderman seeks new trial in sex case

Waukesha - Anthony Balistreri, the former City of Pewaukee alderman convicted of sexually assaulting a boy and girl, is seeking a new trial because he did not receive a fair trial in 2006.

Balistreri, 44, is serving a 45-year prison sentence, will appear in Waukesha County Circuit Court Oct. 6 for a motion regarding a new trial. Assistant State Public Defender John P. Tedesco filed a motion this week challenging a judge's decision to allow the jury while it was deliberating to review a transcript of the boy's testimony.

Tedesco said in his motion that permitting a jury to view a transcript of a witness' testimony leads to an overemphasis of the evidence. Any evidence should have been reviewed before a judge so the prosecutor and the defense attorney could correct any errors, the motion says. The boy's testimony was the "crux of the state's case," the motion says.

Balistreri was convicted of 19 of the 20 felonies with which he was charged. He was charged with numerous sex-related crimes, including assaulting a boy and having sexual contact with a girl.The sexual assaults occurred from 1999 to 2006, including one assault after he was charged. He was also charged with 10 counts of possession of child pornography.

Balistreri served on the Common Council from 2003 to 2005, when he resigned over the allegations.

Man with pretend bomb at City Hall found competent

Waukesha - The man who pretended to bring a bomb into Pewaukee City Hall last month was found competent to stand trial this afternoon.

A court-appointed psychiatrist concluded Malcolm W. Richards II, 28, of Village of Pewaukee, was competent, said Waukesha County Circuit Court Commissioner Martin Binn.

"The doctor's report was he (Richards) was competent to stand trial at this time," Binn said.

Binn asked Richards if he concurred with the report and Richards said yes. Richards is charged with armed robbery and bomb scare.

Richards is scheduled to appear in court Sept. 4 for a preliminary hearing.

According to the criminal complaint, Richards said he wanted to overthrow the government and demanded a gun and police squad. Richards claimed he had "orders from God" and "angelic type beings" to overthrow the government.

Richards went to City Hall at about 4:15 a.m. July 28 and hid in the restroom and left a note near the door, according to the complaint.

At about 9:20 a.m., a city officer noticed a note on the floor outside the bathroom door, according to the criminal complaint. The note said he had a bomb strapped to him and demanded a weapon, the keys to a squad car and be taken to the vehicle.

Richards eventually surrendered to SWAT members who used pepper spray in the bathroom, the complaint said.

Richards was taken into custody and authorities found he did not have a bomb on him.

Richards admitted to making the pretend bomb by taking a vest from a jacket, putting a hole in it and connecting wires from the jacket to a cell phone charger.
Richards wanted to go to Madison first and then Washington, D. C., to "shoot "congressmen and senators." Richards described himself as a "political radical" and a "Masonic Jew who is openly opposed to the government," the complaint said.

Richards is being held on $100,000 cash bail.

City of Pewaukee man charged in fatal crash

Waukesha - A City of Pewaukee man, already convicted six times for drunken driving, was charged Friday in the Aug. 1 fatal crash that killed an Elm Grove man and injured two others.

Daniel P. Henningsen, 42, of W223 N2325 Glenwood Lane, made his initial appearance in Waukesha County Circuit Court Friday and is being held on $1 million bail. Henningsen is charged with homicide by intoxicated use of a vehicle, two counts of drunken driving while causing injury, seventh or more drunken driving, possession of marijuana and possession of drug paraphernalia, driving with a revoked driver's license and four counts related to driving with a prohibited alcohol levels. Henningsen is scheduled to appear in court Thursday for a preliminary hearing.

Henningsen was driving west on Capitol Drive in the City of Brookfield when his Oldsmobile van struck a Jeep at Mountain Drive at about 12:15 a.m., according to the criminal complaint. Pronounced dead at the scene was William E. Gray, 51, of Elm Grove. Gray's wife, Kelley and his sister-in-law, Lori Borden were injured. They were taken by ambulance to a nearby hospital.

Henningsen had to be extricated from his van and was taken by helicopter to Froedtert Hospital where he underwent surgery for his injuries. A blood sample showed Henningsen had a blood-alcohol level of 0.194. A level of 0.08 is considered evidence of intoxication in adult drivers in Wisconsin. People with three or more drunken driving convictions are prohibited from driving with a level of 0.02 or higher.

Police also found a homemade marijuana pipe and a bag containing 7.6 grams of marijuana in Henningsen's van, the compliant said. A drug test showed Henningsen did have marijuana in his system, the complaint said.

Police determined the Oldsmobile was traveling at about 63 mph at the time of impact, the complaint said. Data from the van's air bag control module showed the van was traveling at 70 mph prior to the brakes being applied, the complaint said. The speed limit on Capitol Drive is 50 mph.

Henningsen was arrested for drunken driving in February 1998, August 2002, May 2003, November 2003, December 2003 and February 2005. Henningsen was convicted of drunken driving in February 1998, February 2003, March 2004, October 2004, and twice in April 2005.

Ex-MHS coach facing more charges

Todd  J. Huth, the former girls basketball coach at Mukwonago High School charged with sexually assaulting a student, is now facing similar charges in Kenosha County for allegedly having sex with the same girl one year ago.

Huth, 57, of Racine, is scheduled to appear in court Aug. 28 for a preliminary hearing in Kenosha County Circuit Court where he is facing three felony counts of sexual assault of a student by school staff.

On Friday, Huth is scheduled to appear in Waukesha County Circuit Court and enter into a plea deal with prosecutors. Huth is charged with five counts of sexual assault by school staff in Waukesha County.

According  to the criminal complaint from Kenosha County, Mukwonago police in February informed Kenosha police that the alleged victim gave a full statement Feb. 14 and said she and Huth were traveling to Chicago Aug. 20, 1007, for a birthday party for a relative of Huth. They stopped at a hotel in Kenosha where they engaged in sexual activity, the complaint said. The girl was 16-years-old at the time.

Kenosha police checked the records at the hotel and found Huth had checked in on Aug. 20, the complaint said.

Huth is accused of sexually assaulting the girl,  now 17, several times between Aug. 1 and Sept. 3, 2007, in the basement of her home, including intercourse, the complaint says..

Huth was the coach of the Mukwonago High School varsity girls basketball team that summer. Huth had been an assistant coach with the girl's basketball varsity program since 1998.

According  to the Kenosha complaint, Huth denied all the charges and said that his estranged wife was "behind all the reports, so bitter is the divorce," the complaint said.

Wives of Spancrete workers killed in crash file lawsuit

Waukesha - The widows of two Spancrete Industries employees who died in a 2006 plane crash have filed a wrongful death lawsuit against Spring City Aviation Inc.

Karen Wraalstad of Town of Ottawa and Janet Wehr of New Berlin filed the suit Aug. 13 in Waukesha County Circuit Court and are seeking unspecified damages for the death of Michael Wraalstad, 59, and James Wehr, 47.

he men were in a twin engine 1966 Piper Aztec when it crashed Aug. 14 as it was attempting to land at Chippewa County International Airport near Sault Ste. Marie in Michigan's Upper Peninsula.

Nicholas Gerger, 23, of Town of Delafield, was the pilot but Daniel Nagy, 30, of Town of Merton, was receiving flight instruction from Gerger at the time of the crash, according to a National Transportation Safety Board report released in June.

The report said the crash was due in part to the "pilot's failure to maintain aircraft control during the circling approach and his failure to perform a missed approach when the airplane was no longer in a position to land using normal flight maneuvers," the report said.

Gerger was an instructor at Spring City Aviation, which is based at Crites Field in Waukesha.

Michael Wraalstad was the general manager of the company's trucking division and James Wehr was the chief mechanic. Nagy was the vice-president of development for the City of Pewaukee firm and grandson of the company's founder.

The lawsuit claims Gerger was an inexperience pilot and he lacked experience in piloting the plane. He was also not adequately trained to fly and land the plane in poor visibility, the suit said.

Weather also played a role in the crash, the NTSB reported."Contributing to the accident was the pilot's decision to operate below the approach's authorized minimum descent altitude before having the airport/runway environment visible. Additional factors were the low cloud ceiling and visibility," concluded the report.
Also named in the suit were the insurance companies for Spancrete and Spring City Aviation.

No court date has been set. The suit has been assigned to Judge Ralph M. Ramirez.

Iraq vet wanted to overthrow government

Waukesha - An Iraqi war veteran who held up in a bathroom at Pewaukee City Hall Monday with intentions to overthrow the government will undergo a court order evaluation to determine if he is competent to stand trial.

Malcolm W. Richards II, 28, of 309 Morris St., Village of Pewaukee, made his initial appearance in Waukesha County Circuit Court this afternoon to face felony charges of armed robbery and bomb scare. Richards, who frequently broke out laughing during the hearing, said he wanted to defend himself.

Waukesha County Assistant District Attorney Kevin Osborne asked Richards be held on $100,000 cash bail as he said Richards was "clearly unstable" claiming he had "orders from God and angelic type beings to overthrow the government." Osborne said Richards wanted to kill sentators and congressmen in Washington, D. C. and officials in Madison

Osborne said Richards' mother believes her son is suffering from post traumatic syndrome due to his service in Iraq. Osborne requested a evaluation because he believed "mental disease will become an issue."

Richards, a graduate of Ball State, went to City Hall of Pewaukee Road at about 4:15 a.m. "to set up shop," Osborne said.

Wearing camouflage and pretending to have a bomb by using a cell phone charger with wires from the charger to a vest from a jacket, Richards slid a note under the bathroom door in the public lobby with his demands, according to the criminal complaint.

Those demands included a weapon and a squad car. Richards wanted to go to Madison first and then Washington, D. C., "to place the government under arrest," the complaint said.

Richards objected to the bail amount saying he is not a danger to the public and said his pretend bomb was for his protection "and not an offensive weapon."

"I was a cook in the military. The most I can cook up is some nasty food," he said.

Court Commissioner Martin Binn, who ordered the cash bail, called Richards "a danger to the community."

Richards is scheduled to appear in court Aug. 13 for a review hearing to determine if he is competent.

Ex-HHS coach pleads guilty to sex assault charges

Waukesha - Matthew A. Pagel, 24, pleaded guilty to three counts of sexual assault of a student by school staff at his plea hearing today in the Waukesha County Courthouse.

Two counts of second degree sexual assault of a child and three counts of sex with a child 16 or older were dismissed. Judge Lee S. Dreyfus said he might take the five dropped charges into account when he sentences Pagel at 3 p.m. Sept. 19.

Sexual assault of a student by school staff is a class-H felony that can result in fines up to $10,000 and incarceration for up to six years, three in a secure facility and three under probation. The state prosecutor will not make any sentencing recommendation.

Pagel is a 2002 Hamilton High School graduate who was employed there as a coach and special-education professor during the 2006-07 school year. The charges involved sexual acts that took place between Pagel and the victim near the end of January 2007.


 

Road rage driver gets year in jail

Waukesha - Calling the May 7 road rage incident involving Leonard Litt, 30, ‘bizarre' a judge this afternoon sentenced the Town of Genesee man to one year in the county jail.

Litt entered a guilty plea to one felony count of second-degree recklessly endangering safety in a plea agreement with prosecutors. Litt, formerly of the City of Pewaukee, had been charged with first-degree reckless endangerment, a felony, and a misdemeanor count of hit-and-run to an attended vehicle

Litt was driving on Merrill Hills Road at about 4 a.m. when he approached a car driven by Eileen Belongea of Town of Waukesha at a high speed, according  to the criminal complaint. After passing Belongea's car, he stopped his Jeep Cherokee and turned around and drove toward her. Belongea eventually drove into the City of Waukesha on Sunset Drive and her car was rammed by the Jeep three or four times. Belongea was not injured.

Litt was found by officers about 3 hours later after he hid in a tree, according  to the complaint.

In responding to a questions by Waukesha County Circuit Court Judge Lee S. Dreyfus, Litt said, "I didn't know who it was" and he thought he might have been someone else. Litt admitted he had been drinking and using drugs.

"This is the stuff movies are made up," Dreyfus said. "Someone  is driving down the road and is suddenly rammed."

"There is no logical reason. You thought someone else was following you and going to do something to you," Dreyfus said.

Dreyfus stayed a sentence of 2-1/2 years in prison and three years of extended supervision. He sentenced Litt to four years probation, ordered him to pay $1,200 in restitution, and undergo alcohol and drug treatment. Litt will serve his sentence in the work-release jail.

Judge orders freeze on ex-doctors' assets

Waukesha - A judge this afternoon ordered a temporary injunction to prevent Mark M. Benson, charged in the April 25 fatal crash that took the life of a woman, her unborn child and daughter from selling any of his assets.

Waukesha County Circuit Court Judge Kathryn Foster ordered the injunction in part because of a statement Benson made on the phone to his wife shortly after the crash on Highway 67 in the City of Oconomowoc. Foster made the ruling which will freeze the assets of Benson during a civil lawsuit filed by the family of Jennifer Bukosky. The family filed a wrongful death lawsuit last month. The suit does not specify damage amounts.

Bukosky, 39, of Town of Oconomowoc, her unborn child, Sophia, and daughter Courtney, 10, were killed when Benson's SUV rear-ended Bukosky's Honda Accord.. Bukosky's son, Zachary, 12,was injured as well as another passenger, Deborah Gibbs, 10, who suffered serious injuries, according to the lawsuit.
Foster cited Benson's comment that he made to his wife that he "would sign over all his property to them and sell his guns and it was not going to be worth it and he would get a public defender."

"At best it was a giving up statement," Foster said. "This state alone is an indications of intent."

Benson is charged with three counts of homicide by intoxicated use of a vehicle, two counts of drunken driving while causing injury, and driving with a revoked license.

Man who held police at bay sentenced

Waukesha - A Town of Merton man who threatened his roommates and held police at bay for several hours was sentenced to 15 months in prison May 29.

Robert F. Nelson, 41, entered a guilty plea to a felony charge of failure to comply with an officer. In a plea agreement, a felony charges of second-degree recklessly endangering safety, criminal damage to property and misdemeanor charges of battery and disorderly conduct were dismissed, according to court records.

Nelson was scheduled for an arraignment but entered the plea and his case proceeded directly to sentencing. Waukesha County Circuit Court Judge Paul Reilly also ordered Nelson to two years extended supervision, undergo alcohol and drug treatment and psychiatric evaluation and treatment.

According to the criminal complaint, Nelson threatened to shoot his roommates and was "preparing for war" as he held police at bay for about six hours in a Beaver Lake residence Feb. 27, according to the criminal complaint. He barricaded himself in the house after his roommates fled the residence. He was taken into custody at 4:20 a.m.

Ex-doctor held over for fatal crash

Waukesha - A court commission bound Mark M. Benson over for trial Friday following testimony that the former surgeon was impaired by prescription drugs when his SUV rear-ended a car April 25 in the City of Oconomowoc killing a woman, her unborn child and daughter.

Waukesha County Circuit Court Commissioner Thomas Pieper ordered Benson, 55, of Town of Summit, to stand trial on charges of three counts of homicide by intoxicated use of a vehicle, two counts of drunken driving while causing injury, and driving with a revoked license. Benson is scheduled to appear in court July 14 for an arraignment hearing.

Killed in the crash that occurred at about 3:40 p.m. on Highway 67 near Pabst Road were Jennifer Bukosky, 39, of Town of Oconomowoc, an associate principal at Oconomowoc High School, her unborn child that was due in June and her daughter, Courtney Bella, 10. Also injured were Bukosky's son, Zachary, 12, and Deborah Gibbs, 10, a friend of the family.

A medical toxicologist, Dr. Richard Tovar, testified the level of narcotics found in Benson's blood the day of the fatal crash would have impaired his ability to drive. A state Crime Lab report showed Benson had Xanax, Ambien and Oxycodone in his system.

The morning of the crash, Benson had his prescription for Xanax and Ambien had been filled. Each bottle had 30 pills but when he was questioned at Oconomowoc Memorial Hospital he only had 25 of each, according  to the criminal complaint. Benson told police he had taken the pills during the morning along with one Oxycodone pill.

Benson had the remaining prescription pills in pocket and produced 47 pills including 25 Xanax and 25 Ambien  Benson had purchased 30 of each of the pills that morning.

Tovar, who said he was Benson's physician more than 10 years ago, said the levels shown in the report would mean Benson's reaction time and judgment would have been impaired. Tovar said the pills are central nervous depressants and have sedative properties. Taken together, the pills have a synergy effect and "enhance each other's affects."

Town of Oconomowoc officer Rob Wiercyski, who is a drug recognition expert, also testified that Benson failed several sobriety tests and Benson's speech was slurred and slow. Wiercyski testified in his opinion Benson was under the influence of intoxicants.

Benson is being held in Waukesha County jail on $1 million bail.

Ex-Lisbon official gets jail time for wielding gun at wife

Waukesha - Former Lisbon supervisor James C. Stadler was sentenced this afternoon to three months in the work-release jail for wielding a gun at his wife last June.

Stadler, 42, was ordered to a nine month jail sentence, but Waukesha County Circuit Court Judge J. Mac Davis said Stadler could serve the last six months on electronic monitoring if he follows all jail rules. Davis also ordered Stadler to five years probation and ordered him not to have any contact with his wife or eldest daughter unless they agree in writing to have contact.

In February a jury found Stadler guilty of felony intimidation of a witness, and misdemeanor counts of pointing a firearm at another, three counts of possession of a switchblade and disorderly conduct while possessing a dangerous weapon. As a result of the conviction, Stadler resigned from the Lisbon Town Board.

According to the criminal complaint, Stadler and his wife had on-going problems and Stadler's daughter, Jessica, told police her father would shoot himself, the complaint said.

When Lynn Stadler arrived home on June 8, 2007, the couple began to argue and she told him she had filed for divorce, the complaint said. Jessica Stadler testified at the trial she took her 2-year-old sister out of the house after she saw her father grab a handgun from a cupboard, the complaint said.

James Stadler apologized for his actions during the sentencing.

"I'm sorry Lynn for all I did," he said turning toward her in the gallery. Jessica Stadler was out of the courtroom during her father's statement. James Stadler will begin his sentence May 28.

State shows part of its hand against ex-doctor

Waukesha - Prosecutors produced a report from the state Crime Lab during a preliminary hearing today showing former surgeon Mark M. Benson had taken the day he drove his SUV into the rear of a car killing a woman, her unborn child and her daughter.
The report showed a high level of Ambien in his system as well as the presence of Xanax and Oxycodone. Prosecutors are attempting to show Benson was under the influence of prescription drugs at the time of the crash on Highway 67.
Benson, 55, of Town of Summit is charged for the April 25 crash in the City of Oconomowoc that resulted in the death of Jennifer Bukosky, 39, of Town of Oconomowoc, her unborn child that was due in June and her daughter, Courtney Bella, 10. Also injured were Bukosky's son, Zachary, 12, and Deborah Gibbs, 10, a friend of the family.
At the hearing, Brianne Conway, 18, testified she was driving north on Highway 67 when Benson's Cadillac Escalade went past her at about 60 to 65 mph in a 45 mph zone and she saw the SUV hit the rear of Bukosky's stopped Honda Accord.
City of Oconomowoc Detective Cris Harnisch testified Benson had purchased 30 pills each of Xanax and Ambien that day and was found with 25 pills of each drug in his pocket. Harnisch also testified that Benson was "emotionally flat" while he questioned him after the crash.
The hearing was postponed until May 30 due to a busy court schedule. Prosecutors must prove at the hearing that there is probable cause a felony has been committed. If it does Benson will be bound over trial.

Pewaukee man gets prison for having child porn

Waukesha - A former school bus driver was sentenced today to three years in prison May 14 for possession of child pornography.

Kevin Crull, 43, of the Village of Pewaukee, was also ordered to 10 years of extended supervision by Waukesha County Circuit Court Judge Lee S. Dreyfus

Crull was found to have five images of child pornography on his computer hard drive and he e-mailed an image to a person in Michigan. An investigation into a man in Lake County, Ill., who was found with child pornography eventually led authorities to 14 other people across the U.S., including Crull , who had been receiving or sending child pornography.

Crull was a school bus driver for Dousman Transport.

Judge freezes Benson's assets

Waukesha - A judge Friday afternoon approved a request for a temporary restraining order to freeze the assets of Mark M. Benson who is charged in a fatal crash April 25.

Waukesha County Circuit Court Judge Kathryn Foster issued the order at the request of Michael Bukosky, whose wife, Jennifer Bukosky, 39, of Town of Oconomowoc, her unborn child, and her daughter, Courtney Bella, 10, were killed when a SUV driven by Benson slammed into the back of Jennifer Bukosky's car on Highway 67 in the City of Oconomowoc. Jennifer Bukosky's son, Zachary Bella, 12, and Deborah Gibbs, 10, were also injured in the crash.

Michael Bukosky filed a lawsuit May 7 seeking Benson from divesting his assets after Benson made a statement to that effect on the phone in front of an officer shortly after the crash, the lawsuit said.

Benson, 55, of Town of Summit, a former surgeon, is being held in Waukesha County jail on $1 million bail. Foster scheduled a hearing June 6 to determine if the restraining order should be made permanent.
Benson is scheduled to appear in court Friday for a preliminary hearing.

Jennifer Bukosky was an associate principal at Oconomowoc High School.

Ex-doctor sued over fatal crash

Waukesha - The family of Jennifer Bukosky filed a lawsuit today in Waukesha County Circuit Court against Mark M. Benson of Town of Summit relating to a fatal crash April 25.

Bukosky, 39, of Town of Oconomowoc, her unborn child and daughter Courtney, 10, were killed when Benson's SUV rear-ended Bukosky's Honda Accord on Highway 67 near Pabst Road in the City of Oconomowoc. Bukosky's son, Zachary, 12, was injured as well as another passenger, Deborah Gibbs, 10, who suffered serious injuries, according to the lawsuit.

The suit, filed by Bukosky's husband Michael, is also seeking an temporary injunction to freeze the assets of the former orthopedic surgeon. Benson, according to the suit, allegedly told his wife shortly after the crash that he wanted to divest himself of all his assets, the suit said.

The suit does not specify a specific damage amount.

Ex-physician held on $1 million bail for fatal

Waukesha - In a courtroom filled with more than 100 Oconomowoc High School students, a court commissioner ordered Mark M. Benson be held on $1 million bail for the death of an Oconomowoc school official, her unborn child and her daughter Friday.

Benson, 55, of Town of Summit was charged with three counts of homicide by intoxicated use of a vehicle, two counts of drunken driving while causing injury, and driving with a revoked license.

Killed in the crash was Jennifer Bukosky, 39, of Town of Oconomowoc, and her unborn child, which was due in June. Her daughter, Courtney Bella, 10, died Saturday from her injuries. Bukosky's son, Zachary Bella, 12, was injured and released from a hospital. Another girl, identified only as Deborah, 10, remains hospitalized. Bukosky was an associate principal at Oconomowoc High School.

Benson was driving north on Highway 67 in the City of Oconomowoc at about 3:40 p.m. when his Cadillac Escalade rear-ended Bukosky's Honda Accord near Pabst Road.

According to the criminal complaint, Benson had taken five pills of the anti-depressant Xanax, five Ambien pills, which is a sleep aid, and one Oxycodone pill, a pain killer, that day.

Benson failed a test to determine if he was under the influence, the complaint said. Benson was convicted just two days earler for third-offense drunken driving and was to report to Waukesha County jail May 9. He was sentenced to 75 days in jail and his driver's license was revoked for 30 months.

Ex-cop gets prison for assault

Waukesha - Calling a former Town of Brookfield police officer, now twice convicted of sexual assault, a danger to the community a judge Friday sentenced Daniel A. Mahnke to 20 years in prison

Mahnke, 40, formerly of Sussex, was sentenced by Waukesha County Circuit Court Judge Lee S. Dreyfus Jr. for sexually assaulting a girl over a three year period. After Mahnke is released from prison in October 2027, he will face another 15 years under extended supervision by the state.

The sentencing comes almost 14 years to the day when he was sentenced to 10 years in prison for assaulting a girl in the Town of Oconomowoc.

"Without questions you are a danger to the community," Dreyfus said.
