Waukesha - Under tight security a hearing on the competency of the Village of Pewaukee man who pretended to have a bomb while holding up in a restroom at Pewaukee City Hall July 28 was delayed until Monday.
Attorney Anthony Rosario informed Waukesha County Circuit Court Commissioner Martin Binn Wednesday morning that he was unable to meet with Malcolm W. Richards II who is charged with armed robbery and bomb scare. Four bailiffs were in the courtroom for Richards brief appearance. Typically two bailiffs are on duty.
Rosario said he went to see Richards, 28, of 309 Morris St., twice on Monday but both times was Richards brought to him. Rosario said he did not say why that was the case.
Rosario did say a competency evaluation to determine if Richards was competent to stand trial was completed and he wanted to review it with Richards. Binn ordered jail staff to make Richards available to Rosario Friday. A hearing will be held Monday.
At Richards initial hearing July 29, Richard said he would represent himself and would nto enter a special plea. At that hearing, Waukesha County Assistant District Attorney Kevin Osborne requested a evaluation because he believed "mental disease will become an issue."
Richards claimed he had "orders from God and angelic type beings to overthrow the government," Osborne said at the hearing.
According to the criminal complaint, Richards said he wanted to overthrow the government and demanded a gun and police squad. Richards is being held on $100,000 cash bail.
